These terms govern the use of Hoss-Kick's remote patient monitoring and care management services. By using our services, you agree to comply with these terms and conditions.

Service Agreement

  • Hoss-Kick provides remote patient monitoring and care management services to healthcare providers and their patients
  • Services are provided in accordance with applicable healthcare regulations and Medicare guidelines
  • All services require proper physician orders and patient consent
  • We reserve the right to modify services with appropriate notice to healthcare providers

Healthcare Provider Responsibilities

  • Maintain active medical licenses and appropriate certifications
  • Provide proper patient orders for remote monitoring services
  • Review and respond to clinical alerts and reports in a timely manner
  • Ensure patient eligibility for Medicare reimbursement programs
  • Maintain appropriate malpractice insurance coverage

Patient Responsibilities

  • Use medical devices as instructed by healthcare providers
  • Participate in care management programs as prescribed
  • Provide accurate health information and report changes in condition
  • Maintain device connectivity and report technical issues
  • Follow prescribed treatment plans and medication regimens

Limitations and Disclaimers

  • Remote monitoring services supplement but do not replace regular medical care
  • Emergency situations require immediate contact with emergency services (911)
  • Technology limitations may affect device connectivity or data transmission
  • Clinical decisions remain the responsibility of the treating physician
  • We are not liable for treatment decisions made by healthcare providers

Text Messaging Terms

  • SMS Program Purpose: Our text messaging program is designed for appointment confirmations, scheduling reminders, and follow-up communications only
  • Opt-In Required: Users must explicitly opt in to receive SMS communications from Hoss-Kick by checking the consent box on our forms or texting START to +1 (855) 753-4452
  • Message Frequency: Message frequency varies based on your appointment schedule and care plan requirements
  • Costs: Standard message and data rates may apply as determined by your mobile carrier

Additional Terms

Billing and Payment

  • • Healthcare providers are responsible for proper billing
  • • Payment terms are established in service agreements
  • • Disputes must be reported within 30 days

Termination

  • • Either party may terminate with 30 days notice
  • • Immediate termination for breach of terms
  • • Patient data will be transferred as requested
  • • Outstanding obligations survive termination

Intellectual Property

  • • Hoss-Kick retains rights to proprietary technology
  • • Clinical protocols are Hoss-Kick intellectual property
  • • Patient data remains property of healthcare provider
  • • No unauthorized use of trademarks or copyrights

Governing Law

  • • Terms governed by Florida state law
  • • Disputes resolved through binding arbitration
  • • Venue in Palm Beach County, Florida
  • • Compliance with federal healthcare regulations
